Sunday evening I spoke on a panel in Washington, D.C., about war crimes, and in walked a group of spirited activists led by Laurie Arbeiter wearing "Arrest Bush" sweatshirts and carrying "Arrest Bush" signs, and they were absolutely dumfounded by what they had just experienced. They'd spent the day at the train station in D.C. and on the streets of D.C. as excited Obama celebrators poured in by the tens of thousands, and they'd been unable to walk a dozen steps without people stopping them to have their photo taken with an "Arrest Bush" sign.

It's worth remembering that Bush is approved by 22 percent of Americans and a smaller percentage of non-Americans. It's hard to get under 20 percent in any poll in this country. More people believe in UFOs than approve of Bush. The media meme that prosecuting Bush would cost Obama political capital has not been proven false, but it is absolutely baseless until someone produces something to base it on.

It came as no surprise that House Judiciary Committee Chairman John Conyers began talking about impeachement hearing against President George W. Bush and Vice President Dick Cheney on January 14, 2009. If such hearings come about, according to Conyers, it would be a means of reaffirming constitutional principals.

Many Bush critics think that Conyers put off an impeachment battle during the last two years because of concerns that it might have political repercussions that might have kept the Democrats from winning the larger congressional majorities and the presidency during the 2008 elections.

Wouldn't that be TERRIBLE? Imagine having to worry about whether or not your advice was legal! How unfair!

The White House this morning announced the last-minute pardons of several more persons, ranging from low-level investment bankers to the Giants’ Plaxico Burress, but, in a surprise to many, the list also includes House Speaker Nancy Pelosi (Dem., CA) Although presidential pardons may be given for any reason, and without explanation, the Oval Office issued a rare statement in which President Bush lauded Pelosi’s “collusion” with the Republican administration’s illegal programs of torture and mass surveillance.

In a nod to the incoming administration, the outgoing President also thanked Pelosi for her “bipartisan posture” towards the war in Iraq, noting that she and the Democratic majority “approved more funds for the war than requested” by the Republican administration, despite an overwhelming mandate from her Democratic constituency to expedite a withdrawal.

The calls for a reckoning for the criminals of the Bush/Cheney administration are growing by the day, as the final few days of the Bush presidency tick down, and as new evidence of their crimes keep pouring out of the deflating gas bag that was the Bush White House.

For years, the Democrats in Congress, with a few notable exceptions, have sat on their hands, allowing the ongoing destruction of the Constitution, of the US military, of the nation’s reputation, and of the rule of law, as well as of the institution of Congress itself, by a cabal of Republicans in the White House, led by Vice President Dick Cheney, who have sought to establish an executive-led government that answered only to itself.

History cannot be the judge of Bush and Cheney. The corporate news really is the first draft of history, and there will be no magical leap from its dishonesty to an honest account. Most in the Washington establishment want to protect Bush and Cheney and gang, although the New York Times has now printed one column admitting the obvious point that if the outgoing criminals are not punished, their heirs will repeat their crimes.

Last Sunday President-elect Barack Obama was asked whether he would seek an investigation of possible crimes by the Bush administration. “I don’t believe that anybody is above the law,” he responded, but “we need to look forward as opposed to looking backwards.”

I’m sorry, but if we don’t have an inquest into what happened during the Bush years — and nearly everyone has taken Mr. Obama’s remarks to mean that we won’t — this means that those who hold power are indeed above the law because they don’t face any consequences if they abuse their power.

The Washington Post's David Ignatius today does what he does best: serve
as the spokesman for the Washington establishment's most conventional
wisdom in a way that really illuminates what it is:

To
underscore the message, Obama indicated that he would oppose
retrospective investigations of wrongdoing by the CIA and other
agencies, arguing: "When it comes to national security, what we have to
focus on is getting things right in the future, as opposed [to] looking
at what we got wrong in the past." This is the kind of realism that
will disappoint liberal score-settlers, but it makes clear that Obama has a grim appreciation of the dangers America still faces from al-Qaeda and its allies.
